Divorce Based on Separation of 3 Years or More

If you have been separated from your spouse for three years or more, you may be entitled to be granted divorce on that ground.

Previously, it was necessary that the spouses have resided in separate residences. This criterion has evolved and the Court is now ready to grant divorce on the ground of separation of three years or more even if the spouses reside in the same residence. The Court will examine each case on its own merits to see whether the spouses are for all intents and purposes leading separate lives, and this despite residing in the same house.
